WHAT ARE TYPES OF LMIAs?

  • High-Wage LMIA: This type is for jobs offering wages above the provincial median. A transition plan to reduce reliance on foreign workers is required.
  • Low-Wage LMIA: These are for jobs paying below the provincial median. There are limits on the number of foreign workers allowed.
  • Global Talent Stream LMIA: For innovative firms needing specialized foreign workers. Also for in-demand skilled positions. Progress reviews are separate from compliance checks.
  • Caregiver LMIA: For employers hiring foreign caregivers for children, seniors, or individuals with medical needs.
  • Primary Agriculture LMIA: For employers hiring temporary foreign agricultural workers in primary agriculture roles.
  • PR Support LMIA: Employers supporting skilled foreign workers’ permanent resident visa applications through Express Entry programs. Job offer must meet specific criteria.

Employer Requirements for LMIA

  • Legitimate Business: The employer must operate a genuine and lawful business.
  • Public Goods/Services: They should provide goods or services to the public as part of their regular operations.
  • Financial Capability: The employer must demonstrate the ability to pay the salary of the intended foreign worker.
  • Genuine Need: There must be a legitimate necessity for hiring a foreign worker in the specific position.
  • No Recent Layoffs: The employer should not have laid off employees in the 12 months preceding the LMIA application.
  • Operational Duration: For the PR support stream, the business must have been in operation for at least one year.
